Approval of the Evidence Act by the Federal Council: a major step towards reducing bureaucracy.
Text form instead of written form – simplifications for occupational pension schemes are on the way.
In August 2024, we reported on the planned changes to the Evidence Act. Now it’s official: on October 18, 2024, the Federal Council approved the Bureaucracy Relief Act IV (BEG IV). These groundbreaking changes will come into effect on January 1, 2025. Further details can be found in the linked newsletter from August 2024. Here is an overview of the most important changes:
Significant changes to the Evidence Act
The new regulations make it possible to document the essential contractual terms in text form if:
- The information is made available to employees.
- This information can be saved and printed.
- Employees are requested to confirm receipt of the documents.
- A real advantage for employers. Originally, the legislative process stipulated that employees must actually confirm receipt of the documents. Now the mere request is sufficient.
Exception: In certain sectors covered by the Act to Combat Clandestine and Illegal Employment, the written form is still required. The sectors affected are regulated in Section 2a § 1 of the Act, such as the construction industry or the restaurant and accommodation industry.
